Website Hosting and Development Terms of Service

These Terms of Service ("Terms") outline the rules for using website hosting and development services provided by SDSX, LLC ("SDSX", "we", or "us"), based in Royse City, Texas. By subscribing and paying through Stripe, you ("Client" or "you") agree to these Terms. These Terms apply to your use of our services for an initial 12-month period, followed by a month-to-month subscription.

1. Services Provided

For the Basic $50/month plan, SDSX provides:

  • Website Hosting: Safe and reliable hosting on servers managed by Hostinger, using cPanel.
  • Initial Domain Migration: Moving your domain to our system at the start of your subscription, with SDSX covering most migration costs.
  • Website Creation: Building or updating your website based on your content or preferences, including basic website functions, basic forms that send submissions to an email address you provide, and an internal blog or a link to a blog you provide. The average cost for a website rework is approximately $1,400, but we waive this for the flat monthly fee.
  • Admin Access: Giving you control to update your website and domain via cPanel.
  • Updates: Up to 3 hours of website changes per month (unused hours don't carry over).
  • Additional Features: Features like forms that automatically send to text or integrate with your preferred CRM via REST API are not included in the Basic plan. These require opting in for extra charges, arranged through communication with SDSX and updated in Stripe.

2. Subscription Term and Cancellation

  • Term: Your subscription starts when you sign up and lasts 12 months. After 12 months, it continues month-to-month, and you may continue with SDSX or choose other services.
  • Cancellation:
    • During the first 12 months, only SDSX can end the subscription early, or you can end it if we fail to provide the services listed in Section 1.
    • After 12 months, you or SDSX can end the subscription with 30 days' written notice.
    • We can end the subscription immediately at any time if you don't pay or violate these Terms.

Note: We assume you'll stay at least one additional year after the initial 12 months to help offset the $1,400 website rework cost we cover upfront. However, you can end the subscription after 12 months, and we accept this risk.

3. Payment

  • Monthly Fee: You pay the flat fee set in your Stripe subscription plan (currently $50/month for the Basic plan, subject to change per Stripe settings).
  • Due Date: Payments are due based on your subscription start date and when Stripe processes the charge.
  • Late Fees: Late payments may incur extra fees, as noted in your plan.
  • Payment Method: Paid via Stripe, using your chosen method.

4. Your Responsibilities

You agree to:

  • Provide needed materials (like content or images).
  • Ensure your content is legal and doesn't violate others' rights.
  • Follow our usage rules.
  • Respond quickly to our requests.

5. Our Responsibilities

We will:

  • Keep your website and domain running smoothly via cPanel.
  • Answer your questions and support requests promptly.
  • Protect your private information.

6. Ending the Subscription

When your subscription ends, we will:

  • Facilitate moving your domain away from our servers on our end only. You or your software engineer are responsible for setting up the domain at the new host.
  • Provide only the files you shared with us (e.g., content or images). We don't have access to root website files, as these are managed by Hostinger and are their intellectual property.
  • Not cover any costs or issues from moving your domain or rebuilding your site.

7. Ownership

  • You own the content you provide to us.
  • SDSX and Hostinger own the code, designs, and other intellectual property created for your website, except your original content.

8. Liability

We're not responsible for losses like profits or data. Our liability is limited to what you paid us in the last 12 months.

9. Governing Law

These Terms follow Texas state laws.

10. Entire Agreement

These Terms are the full agreement between you and SDSX, replacing any prior discussions.

11. Changes

We may update these Terms by posting a new version. Continued use of our services means you accept the updated Terms.

12. Invalid Terms

If part of these Terms isn't valid, the rest still applies.

13. Notices

Notices must be in writing, sent by email, certified mail, or delivered in person to the contact info you provide or our designated email.

14. Agreement

By subscribing and paying through Stripe, you confirm you've read, understood, and agree to these Terms.

Analytics & Cookie Policy

Google Analytics

We use Google Analytics (GA4) to understand how visitors interact with our website. This helps us improve our services and user experience. Google Analytics collects information such as:

  • Pages visited and time spent on each page
  • How you arrived at our site (referral source)
  • Your general geographic location (country/region level)
  • Device type, browser, and operating system
  • Interactions with our content

Cookie Usage

Google Analytics uses cookies to collect this data. Cookies are small text files stored on your device. The cookies we use include:

  • _ga: Used to distinguish users (expires after 2 years)
  • _ga_*: Used to persist session state (expires after 2 years)

Your Rights (GDPR & CCPA)

If you are located in the European Union or California, we will ask for your consent before enabling analytics cookies. You have the right to:

  • Opt out: Decline cookies when prompted, or clear your browser cookies at any time
  • Access your data: Request information about the data we collect
  • Delete your data: Request deletion of your analytics data

For users outside the EU and California, analytics are enabled by default to improve our services, but you can still opt out by clearing cookies or using browser privacy settings.

Data Sharing

Analytics data is processed by Google LLC under their Privacy Policy. We do not sell or share your personal data with third parties for marketing purposes.

SDSX: Pages Sync Addon - Privacy Policy & Data Usage

About This App

The "SDSX: Pages Sync Addon" is a Facebook application that allows SDSX website hosting clients to connect their Facebook Business Pages to automatically sync photos and posts to their websites. This app is exclusively for use by existing SDSX website hosting and development clients.

Data We Access

When you connect your Facebook Page through our app, we request access to:

  • pages_show_list: To see the list of Pages you manage
  • pages_read_engagement: To read engagement data on your posts
  • pages_read_user_content: To read posts, photos, and content from your Page

Important: We only request read-only access. We cannot post, modify, or delete any content on your Facebook Page.

How We Use Your Data

Your Facebook Page data is used solely for the following purpose:

  • Displaying your recent Facebook posts and photos on your SDSX-hosted website
  • Automatically syncing new content to keep your website up-to-date

Data Storage & Retention

We do not sell your data. We do not store your Facebook content beyond what is necessary to display it on your website. Content is fetched directly from Facebook's servers and cached temporarily (up to 1 hour) for performance purposes only. We store only the Page Access Token required to fetch your content, which is kept secure and never shared with third parties.

Data Deletion & Removal

You can request deletion of your data at any time by:

  1. Disconnecting the app from Facebook: Go to your Facebook Settings → Apps and Websites → find "SDSX: Pages Sync Addon" → Remove App. This immediately revokes our access to your Page.
  2. Contacting us directly: Email contact@sdsx.io with the subject line "Data Deletion Request - Pages Sync Addon" and include your Facebook Page name. We will delete your stored Page Access Token within 48 hours and confirm deletion via email.
  3. Canceling your SDSX subscription: Upon cancellation of your website hosting subscription, all associated data including Page Access Tokens will be deleted as part of our standard offboarding process.

Third-Party Sharing

We do not sell, rent, or share your Facebook Page data with any third parties. Your data is used exclusively to provide the sync service between your Facebook Page and your SDSX-hosted website.
